Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Pevah Tech Solution for your use of FlowState. By installing or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

2. What the app does

FlowState helps you record and understand your menstrual cycle, symptoms and related health information, including modes for trying to conceive, pregnancy, the time after birth and perimenopause. It gives estimates and general information. It is not a medical device and does not replace a health professional (see the Medical Disclaimer).

3. Who can use it

You may use the app if you can form a binding agreement, or, if you are under 18, with the consent of a parent or guardian who agrees to these Terms for you. The app is for your personal, non-commercial use.

4. Your account and your key

You can use the app anonymously or with an email account. You are responsible for keeping your password, phone and app lock PIN secure. Your data is encrypted with a key protected by your password and your device, so we cannot reset your key or recover your data. Anonymous data is lost if the app is uninstalled or the phone is lost, and resetting a password means older backups cannot be unlocked.

5. Your content

Everything you enter belongs to you. You give us only the permission needed to store your encrypted data and deliver it back to your devices. You are responsible for the accuracy of what you enter; predictions depend on it.

6. Acceptable use

You agree not to: misuse or interfere with the app or its servers; try to access other people's data; reverse engineer the app except where the law allows; use the app for anything unlawful; or use automated means to access the service.

7. Premium subscriptions

Some features require a Premium subscription or one-time purchase. Prices are shown in the app before you buy. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal in your Google Play or App Store settings. Free trials, where offered, turn into paid subscriptions unless cancelled before they end. Payments, refunds and cancellations are handled by the app store under its own terms. Deleting the app does not cancel a subscription.

8. Ads

The free version of FlowState shows non-personalised ads, which are never based on your health data (see the Privacy Policy). You can choose to watch a short rewarded ad to unlock some Premium features for up to 1 hour, or to download a single report. Watching is optional. A reward ends when its time runs out, has no cash value, and does not include features that are only available with Premium. We do not control the content of ads shown by Google and are not responsible for the products they advertise. A Premium subscription removes all ads.

9. Changes to features

We may add, change or remove features, including which features are part of Premium. If we remove a paid feature you have already paid for, we will try to offer a reasonable alternative. We do not promise the app will always be available or free from errors.

10. Our intellectual property

The app, its design, text, articles, graphics and code belong to Pevah Tech Solution or its licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, subject to these Terms.

11. Health information and estimates

Predictions (periods, fertile window, ovulation, due date), charts, the health check and articles are estimates or general information. They may be wrong, especially if cycles are irregular or data is missing. Do not use the app as contraception or to diagnose or treat any condition.

12. No warranty

The app is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including accuracy, fitness for a particular purpose or uninterrupted operation. Nothing in these Terms removes rights you have under the Consumer Protection Act, 2012 or other laws that cannot be excluded.

13. Limitation of liability

To the extent the law allows, Pevah Tech Solution is not liable for indirect or consequential loss, for loss of data you could not restore because a key or password was lost, or for decisions made on the basis of the app's estimates, including unplanned pregnancy. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim. We do not limit liability for death or personal injury caused by our negligence, or for fraud.

14. Ending use

You can stop using the app and delete your account at any time from Profile. We may suspend or end access if you seriously break these Terms, with notice where reasonable. Sections that by their nature should continue (such as liability) survive the end of these Terms.

15. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. For important changes we will tell you in the app before they apply. Continuing to use the app after that means you accept the updated Terms.

16. Law and disputes

These Terms are governed by the laws of Kenya. We will try to resolve any complaint informally first, so please contact us. If we cannot, disputes will be decided by the courts of Kenya.
